Supreme Court Ruled Dowry Givers Who Are Victims Cannot Be Prosecuted Under Dowry Prohibition Act

  • The Supreme Court of India ruled that individuals who give dowry under social compulsion, particularly the bride and her family as aggrieved victims, cannot be prosecuted under the Dowry Prohibition Act, 1961.
  • The Court emphasized that the law recognises the social reality of coercion in dowry cases and provides protection to victims reporting dowry harassment.

Key Highlights

  • The Supreme Court of India clarified that although the Dowry Prohibition Act, 1961 criminalises both giving and taking dowry, victims who give dowry under compulsion cannot be prosecuted.
  • The Court referred to Section 7(3) of the Dowry Prohibition Act, 1961, which protects dowry givers when they file complaints as aggrieved persons.
  • The provision aims to encourage reporting of dowry harassment without fear of legal action against victims.
  • The ruling came while hearing a plea by a husband who argued that First Information Reports should also be filed against the wife and her family since they admitted to giving dowry.
  • The Court rejected the argument and observed that such admissions are often made by victims while seeking justice and should not result in prosecution.
  • The Court noted that Section 7(3) recognises that families are often compelled to give dowry due to social pressure and coercion.
  • The protection under the provision ensures:
    • protection of victims from prosecution,
    • encouragement to report dowry-related offences, and
    • clear distinction between offenders and victims.
  • The Court also referred to recommendations of the Joint Parliamentary Committee, which observed that parents and families giving dowry are often victims of social customs and should not be treated at par with those demanding or accepting dowry.
  • The judgment strengthens the legal framework against dowry by recognising ground realities of social coercion, protecting victims from legal consequences, and encouraging women to report harassment cases without fear.
