Supreme Court Ruled Right to Vote and Contest Elections Are Statutory Rights
- The Supreme Court of India clarified that the right to vote and the right to contest elections are statutory rights and not Fundamental Rights under Part III of the Constitution of India.
- The judgment was delivered by a Bench comprising V. Nagarathna and R. Mahadevan in a case related to cooperative society elections in Rajasthan.
Key Highlights
- The Supreme Court of India ruled that the right to vote is a statutory right and not a Fundamental Right.
- The right to contest elections is also a statutory right subject to eligibility conditions prescribed by law.
- These rights are governed by the Representation of the People Act, 1950 and the Representation of the People Act, 1951.
- The case originated from a dispute related to elections in District Milk Producers Cooperative Unions under the Rajasthan Cooperative Societies Act, 2001.
- The Supreme Court upheld the validity of bye-laws prescribing eligibility conditions such as:
- minimum number of days of milk supply,
- quantity of milk supplied,
- operational status of cooperative societies, and
- audit compliance standards.
- The Court set aside earlier decisions of the Rajasthan High Court that had struck down these bye-laws.

- Therefore, internal election matters of cooperative societies normally do not fall within judicial review under Article 226 of the Constitution of India, unless there is clear illegality.
