Gujarat High Court Issued Policy Banning Use of Artificial Intelligence in Judicial Decision-Making and Judgment Drafting
- The Gujarat High Court issued a policy banning the use of Artificial Intelligence (AI) in judicial decision-making and drafting of judgments, emphasizing that human reasoning must remain central to the justice delivery system.
- The court acknowledged that Artificial Intelligence can improve efficiency, but clarified that fairness, accountability and judicial independence cannot be compromised by delegating judicial responsibilities to technology.
- As per the guidelines issued by the Gujarat High Court:
- Artificial Intelligence cannot be used for decision-making or adjudication
- It cannot assist in judicial reasoning or interpretation of law
- Use of Artificial Intelligence for drafting or generating judgments, orders or rulings is prohibited
- Artificial Intelligence cannot influence bail decisions, sentencing or determination of legal rights
- Even reviewing Artificial Intelligence-generated judgments is not acceptable, reinforcing that judicial responsibility cannot be delegated
- The policy highlighted several risks associated with the use of Artificial Intelligence in judicial processes:
- Risk of bias and hallucinations, where Artificial Intelligence systems may produce incorrect or misleading outputs affecting fairness of judgments
- Confidentiality concerns, as feeding sensitive legal data into Artificial Intelligence tools may lead to data breaches or misuse
- Threat to judicial independence, as reliance on Artificial Intelligence may influence decision-making and undermine the autonomy and accountability of judges
- The Gujarat High Court also imposed strict restrictions on the handling of legal data using Artificial Intelligence, stating that Artificial Intelligence is not allowed to:
- Process names, addresses or personal details of individuals or parties
- Access confidential legal strategies or communications
- Generate or modify evidence or legal documents
- Categorize or evaluate evidentiary material related to judicial proceedings
- However, the court permitted limited use of Artificial Intelligence in non-decisional and administrative functions, including:
- Legal research and case law analysis
- Identifying precedents and statutory interpretation with verification
- Supporting administrative tasks and case management
